This presentation examines the topics of generative AI, agency, and legal personhood. We will explore how the law should address generative AI systems. Our goal is to incorporate both philosophy of action, agency, and a technical understanding of what generative AI models can and cannot do. We focus on health law as a case study. We aim to analyze the U.S. regulatory framework, particularly FDA law, and assess the European approach under the new EU AI Act to identify lessons—both positive and negative—that the United States can learn from the EU.
